Le dossier progresse lentement, ce qui est normal considérant que le dossier est lourd et complexe et considérant qu’il n’y a plus aucune urgence depuis la levée du passeport vaccinal.

En tout cas, une grosse étape s’en vient : nous allons interroger les témoins du gouvernement, c’est-à-dire ceux qui ont signé une déclaration sous serment, les 22, 23, 24 et 27 mai prochain. C’est une grosse partie du travail puisque dans un dossier dit de contrôle judiciaire, la plupart, pour ne pas dire la quasi-totalité des témoignages ont lieu hors cour et non pas au procès. Nous pourrons déposer la transcription sténographique de ces interrogatoires au procès.

Ces interrogatoires vont engendrer des coûts substantiels, sans doute 5000 $ de sténographe, voire plus. Pour ma part, je prévois au moins une semaine de préparation en plus des journées d’interrogatoires. Pour maximiser notre force de frappe et mener ce dossier à bien comme il se doit, il faudrait que le groupe se cotise de nouveau. Compte tenu du dépôt que nous avons versé à un de nos experts, il ne nous reste que 4916,75 $ en fidéicommis. Il faudrait récolter un 10 000 à 15 000 $ pour être confortables pour quelques temps et pour nous assurer de faire une bonne enquête.

Une fois que les interrogatoires auront été réalisés, nous risquons d’obtenir des documents additionnels et nous pourrons ensuite penser à faire notre contre-preuve, c’est-à-dire déposer une ou plusieurs expertises.

Une nouvelle campagne sera lancé sous le même nom, mais avec un "2" à la fin.

MISE À JOUR en date du 29 juin 2023 : les avocats ont convenu d’un échéancier. Le gouvernement aura jusqu’au 13 octobre pour produire sa preuve documentaire justificative, après quoi les témoins ordinaires et experts du gouvernement seront interrogés avant le congé des Fêtes.

Résumé

Nous sollicitons des dons du public afin se donner des moyens financiers réalistes pour contester en justice la légalité constitutionnelle du passeport vaccinal. Nous croyons qu’il est d’intérêt public de faire la lumière sur cette affaire afin de bien comprendre ce qui s’est passé, identifier les effets bénéfiques et préjudiciables de la mesure et trancher les questions juridiques qui, malheureusement, n’ont pu être tranchées en temps utile. Nous espérons récolter une provision d’au moins 50 000 $ afin de payer les frais d’avocat, frais d’expertise et autres déboursés.

Historique

Au cours de l’été 2021, le gouvernement du Québec, à l’instar d’autres juridictions dans le monde, a instauré un passeport vaccinal empêchant les personnes non vaccinées d’accéder à des lieux publics considérés comme non essentiels. Dès le mois de septembre 2021, l’avocat beauceron Hans Mercier introduit un recours judiciaire en son nom personnel afin de contester cette mesure inédite qui soulève de nombreuses questions juridiques. Il s’adjoindra plus tard du notaire Gaston Vachon comme codemandeur en réponse à l’argument du gouvernement du Québec à l’effet qu’étant lui-même adéquatement vacciné, il n’a pas l’intérêt juridique requis pour prendre action. Mercier et Vachon demanderont la suspension urgente du passeport vaccinal (dans l’attente du jugement final) mais cette demande sera rejetée.

En novembre 2021, une autre action est déposée par 6 demandeurs faisant partie d’un regroupement de parents appelé « Tous unis pour nos ados ». Cette action, pilotée par l’avocat de Gatineau, William Desrochers, vise à rendre le passeport vaccinal inapplicable aux personnes de 13 à 17 ans en milieu scolaire, parascolaire et sportif. On plaide que ce groupe de non-vaccinés est disproportionnellement affecté par le passeport vaccinal vu l’importance de l’inclusion à cet âge crucial du développement et parce que les bénéfices en termes de santé publique sont très douteux. Par exemple, les non-vaccinés qui sont dans un programme de type sport-étude peuvent côtoyer étroitement leurs collègues vaccinés toute la journée mais ils sont exclus de la pratique additionnelle du midi ou du soir et des compétitions parce que cela ne fait pas partie du programme scolaire régulier.

En février 2022, après que la variant Omicron se soit répandu comme une trainée de poudre à travers la population malgré le haut taux de vaccination et l’exclusion des non-vaccinés, la colère grogne partout dans le monde. Au Canada, le convoi de la liberté a été un moment-phare de cette période où la cohésion sociale a été mise à rude épreuve. Peu à peu, les provinces canadiennes et les autres juridictions à travers le monde abolissent toute forme de passeport ou obligation vaccinale.

Le gouvernement du Québec (comme tous les autres au Canada et ailleurs) s’adresse ensuite sans tarder au tribunal afin de faire rejeter les contestations judiciaires parce qu’elles sont devenues théoriques. En principe, quand une mesure législative est abolie, les tribunaux doivent éviter de se prononcer puisque le litige a disparu. C’est ainsi que la majorité des contestations ont été rejetées à travers le Canada pour ce motif. Cela signifie que le dossier est terminé.

Par chance, les dossiers susmentionnés ont résisté à la vague de rejets des contestations judiciaires devenues théoriques. Pour ces deux actions, le tribunal a usé de son pouvoir discrétionnaire qui lui permet d’autoriser la poursuite d’un recours même s’il est devenu théorique. Ce n’est pas quelque chose qui arrive très souvent et cela se justifie par l’importance des questions soulevées.

Les deux dossiers ont été réunis en un seul au cours du mois de février 2023, ce qui est l’avantage de toutes les parties impliquées. Pour les demandeurs, l’union fait la force alors que pour le gouvernement, il y a une économie à faire le débat dans un seul et même dossier.

Suite du dossier

Très bientôt, le gouvernement devra déposer ce qu’on appelle sa preuve justificative : déclarations sous serment de hauts fonctionnaires, expertises et autres éléments de preuve expliquant en quoi l’atteinte aux droits fondamentaux des individus était justifiée en droit. S’en suivront des interrogatoires par les avocats des demandeurs et ceux-ci pourront par la suite faire une contre-preuve, incluant des contre-expertises. Il est probable que le procès n’aura pas lieu avant 2024.

Pourquoi continuer

Ce dossier est une occasion en or de faire une véritable enquête quant aux mesures sanitaires ayant sévi durant la pandémie de Covid-19. La population doit obtenir des réponses.

Des questions juridiques, une fois tranchées, pourraient aussi permettre de faire évoluer le droit positivement. Le refus de se faire vacciner est-il un « cas de conscience » mettant en jeu la liberté de conscience? La liberté de conscience est un droit fondamental qui existe bel et bien, mais il est pratiquement inexploré en jurisprudence. Le statut vaccinal est-il ou devrait-il être un motif de discrimination interdit par nos chartes des droits et libertés? À quel point un vaccin doit-il être efficace pour justifier un empiètement sur les droits et libertés fondamentaux de la population générale? Manifestement, nous sommes en droit nouveau et trancher toutes ces questions n’est pas dénué d’intérêt.

Pourquoi contribuer

Ce dossier dépasse manifestement les intérêts individuels des demandeurs et ceux-ci risquent de s’épuiser sans support financier de la population générale. Les demandeurs devront sacrifier temps et argent pendant de nombreuses années et ont besoin de sentir qu’il y a des gens derrière eux. Il est probable que le dossier aboutisse à la Cour d’appel, puis à la Cour suprême, et que le dossier s’étale sur plusieurs années.

Legal challenge to the Vaccination Passport

UPDATE as of April 20th, 2024:

The case is progressing slowly, which is to be expected given the complexity of the issue and the fact that there is no longer any urgency since the lifting of the vaccine passport.

In any case, there's a big step ahead: we'll be interviewing the government's witnesses, i.e. those who have signed an affidavit, on May 22, 23, 24 and 27. This is a big part of the job, since in a case involving judicial review, most, if not almost all, of the testimony takes place out of court, and not at trial. We will be able to file the stenographic transcript of these interrogations at trial.

These examinations will entail substantial costs, probably $5,000 for a stenographer, if not more. For my part, I anticipate at least a week of preparation in addition to the interrogation days. To maximize our strike force and bring this case to a successful conclusion, the group will have to contribute again. Given the deposit we paid to one of our experts, we have only $4916.75 left in trust. We'd need to raise another $10,000 to $15,000 to be comfortable for a while and to make sure we do a good investigation.

Once the interrogations have been carried out, we're likely to obtain additional documents, and then we'll be able to think about making our counter-evidence, i.e. filing one or more expert reports.

A new campaign will be open under the same name but with a "2" at the end.

the lawyers have agreed on a timetable. The government will have until October 13 to produce its supporting documentary evidence, after which the government's ordinary and expert witnesses will be examined before the holiday break.

Summary

We are asking for donations from members of the public in order to give ourselves realistic financial means to contest the constitutional legality of the vaccine passport before the courts. We believe it is in the public interest to bring light to this situation in order to completely understand what happened, to identify both beneficial and prejudicial effects of the measure and to have a ruling on the legal questions which, unfortunately, were never argued in a reasonable timeframe. We hope to collect a cushion of at least $50,000 in order to pay lawyers’ fees, experts’ fees and other expenses.

History

During the summer of 2021, the Quebec Government, like other governments in the world, put in place a vaccine passport which forbade unvaccinated people access to public areas considered non-essential. From the month of September 2021, a lawyer from Beauce, Hans Mercier filed an action in his own name in order to contest this unprecedented measure which raised numerous legal questions. The notary Gaston Vachon was later added as co-plaintiff in answer to the argument from the Quebec government that given that Mercier himself was adequately vaccinated, he didn’t have a sufficient interest to bring a judicial application on this matter. Mercier and Vachon asked for an urgent suspension to the vaccine passport (while awaiting a final judgment) but this request was denied.

In November 2021, another action was filed by 6 plaintiffs who were part of a group of parents called « Tous unis pour nos ados » or ‘Together for our teens’. This action, filed by the Gatineau based lawyer, William Desrochers, aimed at making the vaccine passport inapplicable to individuals aged between 13 and 17 years old within a school environment, during extra-curicular actvities and in sporting activities more generally. The group argues that this group of unvaccinated citizens are dispropotionally affected by the vaccine passport due to the important role of inclusion for development during this age range and because the benefits for public health are extremely doubtful. For example, unvaccinated students who are in a study-sports program can rub shoulders closely with their vaccinated classmates all day but then be excluded from the extra activity at lunchtime or after school or competitions because it is not considered to be a part of the regular school program.

In February 2022, after the Omnicron variant had spread like wildfire through the population despite the high rate of vaccination and the exclusion of the unvaccinated, anger was rumbling everywhere in the world. In Canada the Freedom Convoy was a key moment of the period, where social cohesion was being deeply tested. Little by little, Canadian provinces and other juridictions in the world abolished all forms of vaccine passports or vaccinal obligation.

The Quebec government (like all the others in Canada and elsewhere) then addressed the court without delay in order to have all legal challenges terminated because they had become moot. In principle, when a challenged legal measure is abolished, the courts should avoid speaking out because the litigation has dissappeared. For this reason, the majority of Covid-related legal challenges were dismissed across Canada. This means that the file is closed.

Luckily, the files mentionned above resisted the wave of dismissals. For these two challenges, the court used its discretionary power which allows them to authorize the pursuit of a claim even if it has become theoretical. This is not something which happens very often and it is justified by the importance of the questions brought up.

The two files were united and became one during the month of February 2023, which is to the advantage of all parties involved. For the claimants, there is strength in union while for the government, it is more economic to debate the issues in one sole file.

Next steps in the file

Very soon, the government has to submit its supporting evidence: affadivits from senior officials, expert opinions and other evidence explaining how the infringement of the fundament rights of individuals was justified in law. This will be followed by interrogations conducted by the plaintiffs’ lawyers and the plaintiffs will then be able to provide rebuttal evidence, including counter expertise. It is likely that the trial will not take place before 2024.

Why continue?

This file is a golden opportunity to carry out a true inquiry concerning the health measures used during the Covid-19 pandemic. The population deserves answers.

The legal questions, once asked, could also allow the law to evolve positively. Is the refusal to be vaccinated a ‘case of conscience’ putting at risk the freedom of conscience? Freedom of conscience is a human right which definitely exists but it is practically unexplored in jurisprudence. Is vaccination status or should it be a means of discrimination forbidden by our charters of rights and freedoms? At what point should a vaccine be efficient to justify an encroachement on the fundamental rights and freedoms of the general population? Obviously, this is an unprecedented situation and answering all these questions is not without interest.

Why contribute?

This issue is clearly beyond the individual interests of the plaintiffs and they are likely to burn out without financial support from the general public. The plaintiffs will sacrifice time and money during numerous years and they need to feel that there are people supporting them. It is likely that the case will go to the Court of Appeal and the Supreme Court, and that the case will drag on for several years.
